In connection with the requirements of Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR), ASTEK Poland Sp. z o. o. based in Warsaw, provides you with required information about the principles of processing your personal data and related rights.

Personal data – information about a physical person who is identified or identifiable by one or more factors specific to his/her physical, physiological, genetic, mental, economic, cultural or social identity, including device IP, location data, Internet identifier and information collected through cookies and other similar technology;

Policy – this Privacy Policy;

GDPR / RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of physical persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;

Service / Website – the website run by ASTEK Polska sp. z o.o. at the following link: www.astek.pl;

User / Candidate – any physical person, including a job applicant, person asking a question, visiting the Website or using one or more of the services or functionalities described in this Policy.

The controller of personal data processed via www.astek.pl, is ASTEK Polska sp. z o.o. with its registered office in Warsaw, Al. Jana Pawła II 22, 00-133 Warszawa, Poland.

ASTEK Polska has appointed Mrs. Joanna Rycaj as a Data Protection Officer.

In terms of recruitment, we process your data:

  • related to the implementation of the recruitment process for ASTEK Polska on the basis of your voluntary consent (Article 6(1)(a) of the GDPR/RODO, in connection with Article 22(1), § 1 of the Polish Labour Code),
  • related to the projects carried out for ASTEK Polska’s customers. Your data will be made available on the basis of the Controller’s legitimate interest (Article 6(1)(f) of the GDPR/RODO). For more information, see Chapter 6,
  • by seeking your employment in future recruitment processes (where you have given your consent – Article 6(1)(a) of the GDPR/RODO),
  • for the purpose of possibly establishing, investigating or defending against possible claims (Article 6(1)(f) of the GDPR/RODO).

In terms of establishing a relationship with potential customers or suppliers, we process your data:

  • on the basis of activities aimed at signing an agreement, including discussions and negotiations (Article 6(1)(b) of the GDPR/RODO).

 

In terms of handling of the request contained in the agreement form, we process your data:

  • on the basis of your consent (Article 6(1)(a) of the GDPR/RODO) in order to handle the request contained in the agreement form.

In terms of organisation and running of competitions, we process your data:

  • on the basis of your voluntary consent to the processing of personal data (Article 6(1)(a) of the GDPR/RODO).

In terms of use of the website, we process your data:

  • in order to provide services electronically in terms of providing Users with access to the content collected on the Website – the legal basis for the processing is Article 6(1)(f) of the GDPR/RODO – the Controller’s legitimate interest in providing Users with access to the content collected on the Website, informing them about the activities undertaken by the Controller and events organised by the Controller, conducting communication and marketing with entities that benefit from the support of the Controller;
  • for analytical and functional purposes – the legal basis for the processing is the Controller’s legitimate interest (Article 6(1)(f) of the GDPR/RODO), which consists in conducting analyses of Users’ activities as well as their preferences in order to improve the functionalities used and services provided;
  • in order to improve the performance of the Website – the legal basis for the processing of your personal data is the Controller’s legitimate interest (Article 6(1)(f) of the GDPR/RODO) in ensuring the highest quality of the services provided on the Website;
  • for the use of advertising cookies – the legal basis for the processing of your personal data is the Controller’s legitimate interest (Article 6(1)(f) of the GDPR/RODO).
  1. With entities that process your data on our behalf (e.g. providers of services related to the implementation of recruitment processes, entities operating our ICT systems or providing us with ICT tools, entities providing consultancy, advisory services, etc.).
  2. With entities entitled to receive them under the law (e.g. courts, legal protection authorities, administrative authorities, supervisory authorities).
  3. With ASTEK Group entities, i.e. companies with capital ties to ASTEK International SASU, headquartered in Boulogne-Billancourt, France, in connection with financial and management accounting and ongoing reporting on the functioning of ASTEK Polska.

Whenever we share your data, we will ensure that only the minimum information necessary to fulfil the purpose of the processing is provided.

Your personal data are not transferred outside the European Economic Area or to international organisations.

ASTEK Polska recruits for its own needs and for clients to whom it provides services to deliver Specialists or teams of Specialists (so-called body leasing).

When recruiting for a client by ASTEK Polska, the first stage of recruitment is an internal interview and technical tests (practical skills verification). The outcome of the interview is to decide whether the candidate will be offered to the Client or not. Once the candidate has been positively verified, his/her CV is forwarded to the Client. The Client verifies the presented candidate and then informs of his/her decision regarding the candidate.

If the decision is positive – the Client arranges an interview with the candidate through the customer contact officer. After the interview, the Client decides whether or not to hire the candidate.

In the context of personal data provided by ASTEK Polska to customers and their processing of personal data, we inform you that:

  • ASTEK Polska is a Personal Data Controller;
  • Sharing personal data with the Client is based on the legitimate interest of the Personal Data Controller (Article 6(1)(f) of the GDPR/RODO). At the same time, it should be noted that when an ASTEK Polska employee contacts a candidate, he/she is informed to which Client his/her application is to be directed. The candidate has the right to object to the processing of his/her personal data (transfer of data to a client of ASTEK Polska) based on the legitimate interest of the Controller. If an objection is submitted, the data will not be provided to the ASTEK Polska’s Client;
  • The Client becomes a separate Data Controller, independently provides a proper legal basis for the processing of the candidate’s personal data received and fulfils the information obligation under Article 13 of the GDPR/RODO;
  • The personal data of the candidate who has consented to the processing of personal data in connection with the recruitment will be processed up to 3 months after the end of the recruitment process;
  • Where a candidate has consented to the processing of personal data for future recruitment, personal data will be processed for a period of 3 years counting from the end of the year in which consent was taken;
  • You have the right to withdraw your consent to the processing of your personal data, without prejudice to any action taken prior to withdrawal;
  • In connection with the application of the legal basis of Article 6(1)(f) of the GDPR/RODO, in connection with the sharing of personal data with ASTEK Polska’s customers – we inform you that the test of the balance of the controller’s legitimate interest is available at the request of the data subject (candidate).
  1. In terms of recruitment, we will keep your data for up to 3 months after the end of the given recruitment process. If you have consented to the processing of your data for the purposes of future recruitment processes, we will process your data for a period of 36 months counting from the end of the year in which consent was given or until you withdraw your consent to the processing of your personal data.
  2. In terms of handling of the enquiry contained in the agreement form, we will keep your data for a period of time until the handling of the enquiry contained in the agreement form is completed, and thereafter for the period and to the extent required for ASTEK Polska to pursue the legitimate interest of the controller.
  3. In terms of contacting representatives of potential customers or suppliers, data will be processed for the duration of ASTEK Polska’s cooperation with the customer/supplier or for the duration of negotiations with the potential customer / supplier.
  4. In terms of organisation and running of competitions, personal data will be processed for the duration of the organisation and running of the competition. The deletion of data will take place 6 months after the end of the competition.
  5. In terms of use of the website, the duration of keeping cookies depends on their type. You will find precise information on the duration of keeping cookies in the “cookie settings” panel.

Otherwise, we will keep your personal data for the period necessary to fulfil the purposes for which the personal data were collected or for which they are processed; to the extent necessary to comply with an applicable legal requirement or to the extent indicated under applicable archiving legislation.

Remember that you have the right to:

  1. access to the content of your personal data, including the right to obtain a copy of that data;
  2. request the rectification (amendment) of your personal data if the data are incorrect or incomplete;
  3. request the deletion of your personal data (the so-called “right to be forgotten”) – in case: (i) the data are no longer necessary for the purposes for which they were collected or otherwise processed; (ii) you have objected to the processing; (iii) you have withdrawn the consent on which the processing is based and there is no other legal basis for the processing; (iv) the data are processed unlawfully; (v) the data must be deleted in order to comply with a legal obligation;
  4. request the restriction of the processing of your personal data when: (i) you dispute the accuracy of your personal data; (ii) the processing is unlawful and you object to the deletion of your data, requesting instead the restriction of processing; (iii) we no longer need your data for our purposes, you will need it to establish, defend or assert claims; (iv) you have lodged an objection to the processing of your data – until such time as it is determined whether the legitimate grounds on the part of the controller override the grounds for the objection;
  5. portability of your personal data where: (i) the processing is based on an agreement concluded with you or on the basis of your consent; (ii) the processing is carried out by automated means;
  6. object to the processing of your personal data, including profiling, when: (i) there are reasons relating to your particular situation and; (ii) the processing is based on necessity for the legitimate purposes of the controller.
  7. withdraw your consent to the processing of your personal data to the extent that you have given your consent to the processing of your personal data at any time without affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

In addition, you have the right to lodge a complaint with the competent supervisory authority, i.e. the President of the Personal Data Protection Office, if you consider that our processing of your data violates the provisions of the General Data Protection Regulation “RODO”.

The Controller will not make automated decisions, including decisions resulting from profiling, based on your personal data.

The provision of personal data is entirely voluntary. However, your failure to provide your data will result in your inability to participate in the recruitment process or in future recruitment processes. The failure to provide your data will also result in the impossibility to process your application included in the contact form and to participate in a competition organised by ASTEK Polska.

The Controller uses cookies mainly to provide the User with services provided electronically and to improve the quality of these services. In this regard, the Controller and other entities providing analytical and statistical services use cookies to store information or access information already stored in the User’s telecommunications terminal equipment (computer, telephone, tablet, etc.). The use of cookies on the Website is not intended to identify Users.

Cookies are small text files sent by a web server, stored by the browser’s computer software and installed on the User’s device when browsing the Websites. When the browser reconnects to the website, the website recognises the type of device from which the User is connecting. The parameters allow the information they contain to be read only by the server that created them. Cookies therefore facilitate the use of previously visited websites.

Essential cookies

  1. The Controller uses essential cookies primarily to provide the User with the services and functionalities of the Website that the User wishes to use. The essential cookies may only be installed by the Controller through the Website.

Functional and analytical cookies

  1. Functionality cookies are used in order to remember and adapt the Website to the User’s choices, among others in terms of language preferences. Functional cookies may be installed by the Controller and his/her partners through the Website.
  2. Analytics cookies allow us to obtain information such as the number of visits and sources of traffic to the Website. They are used to determine which pages are more and which are less popular, and to understand how Users navigate the Website by keeping statistics on the Website traffic. The processing is done to improve the performance of the Website. The information collected by these cookies is aggregated, so they are not intended to establish your identity. Functionality cookies may be installed by the Controller and his/her partners through the Website.
  3. The processing of personal data in connection with the use of functionality and analytics cookies is subject to the User’s consent to the use of (separately) functionality and analytics cookies via the cookie consent management platform. This consent can be withdrawn at any time via this platform.

Performance cookies

  1. Performance cookies are used to understand and analyse the key performance indicators of the Website to help provide a better User experience. Performance cookies may be installed by the Controller and his/her partners through the Website.
  2. The processing of personal data in connection with the use of performance cookies is possible after obtaining the User’s consent via the consent management platform. This consent can be withdrawn at any time via this platform.

Advertising cookies

  1. Advertising cookies allow the advertising content displayed to be tailored to the interests of Users on and off the Website. Based on the information from these cookies and the User’s activity on other services, a profile of the User’s interests is built. Advertising cookies may be installed by the Controller and its partners through our Website.
  2. The processing of personal data in connection with the use of advertising cookies is possible after obtaining the User’s consent via the consent management platform. This consent can be withdrawn at any time via this platform.
